AGREEMENT TO TERMS
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you, whether personally or on behalf of an entity (“you”), and Epic Gymnastics (“Epic Gymnastics,” “we,” “us,” or “our”), concerning your access to and use of https://epicgymnastics.com (the “Site”), as well as any related services, registrations, programs, memberships, media channels, or applications connected thereto (collectively, the “Services”).
By accessing the Site, enrolling in classes, submitting any form, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
IF YOU DO NOT AGREE WITH THESE TERMS, YOU MUST DISCONTINUE USE OF THE SITE AND SERVICES IMMEDIATELY.
We reserve the right to modify these Terms at any time. Changes will be reflected by updating the “Last Updated” date. Continued use of the Site or Services after changes constitutes acceptance of the revised Terms.
ELIGIBILITY
The Site and Services are intended for individuals 18 years of age or older. Parents or legal guardians must complete registrations and agreements for any minor participant.
By enrolling a minor, you represent and warrant that you are the legal parent or guardian and have the authority to enter into this agreement on their behalf.
INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site and all content including text, graphics, logos, images, videos, designs, and software (“Content”) are the proprietary property of Epic Gymnastics and are protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes only.
No portion of the Site may be copied, reproduced, distributed, or commercially exploited without our written consent.
USER REPRESENTATIONS
By using the Site or Services, you represent that:

All information provided is accurate and current.

You will maintain the accuracy of such information.

You will not use the Site for unlawful purposes.

You will comply with all applicable laws and regulations.
We reserve the right to suspend or terminate access for false information or violations.
MEMBERSHIP, ENROLLMENT & BILLING
Enrollment in classes or programs constitutes agreement to ongoing billing until properly cancelled pursuant to our Drop Policy below.
Tuition is billed according to the selected program and payment schedule. Failure to attend classes does not constitute cancellation and does not relieve payment obligations.
Epic Gymnastics reserves the right to adjust tuition rates with reasonable notice.
Accounts with outstanding balances may be suspended or denied participation.
MEMBERSHIP CANCELLATION & DROP POLICY
1. Required Method of Cancellation (Drop Form Only)
All membership cancellations (“drops”) must be submitted through our official Drop Form:

We do not process cancellations via:

phone calls
-
voicemails
-
text messages
-
emails
-
verbal notice to staff
-
third-party messaging platforms
If the Drop Form is not submitted, your account will remain active and billing will continue. The Drop Form is the sole valid method of cancellation.
2. Fourteen (14) Day Notice Requirement
A minimum of fourteen (14) calendar days’ notice is required for all membership cancellations.
The selected drop date must be at least fourteen (14) days from the date the Drop Form is submitted.
If a date is submitted that does not comply with this requirement, Epic Gymnastics reserves the right to adjust the effective drop date to meet the required notice period.
3. Billing Responsibility
Tuition and any applicable fees will continue through the effective drop date.
Members are financially responsible for all charges incurred during the required notice period, regardless of attendance.
No refunds or retroactive cancellations will be granted due to:

failure to attend

failure to submit the Drop Form
-
assumptions that verbal notice was sufficient
-
claims of prior communication not submitted via the Drop Form
4. Family-Level Enrollment
For administrative clarity:

A drop applies to the family account as a whole unless otherwise specified.

If at least one student remains enrolled within the family account, the account remains active.

Removing one child from classes while another remains enrolled is treated as an enrollment adjustment, not a full membership cancellation.
5. Confirmation of Cancellation
Upon submission of the Drop Form:

The request is recorded.
-
The effective drop date is established (subject to the 14-day notice requirement).
It is the member’s responsibility to retain confirmation of submission and ensure the form was successfully submitted.
ASSUMPTION OF RISK
Participation in gymnastics, tumbling, trampoline, parkour, and related activities involves inherent risks, including but not limited to bodily injury.
By enrolling a participant, you acknowledge and accept these risks. Separate waivers may be required prior to participation.
PROHIBITED ACTIVITIES
You agree not to:

Use the Site for unlawful purposes

Interfere with Site security
-
Attempt unauthorized system access

Harass staff or participants
-
Submit false information
Violations may result in termination of Services.
THIRD-PARTY LINKS
The Site may contain links to third-party websites. Epic Gymnastics is not responsible for their content, accuracy, or practices.
DISCLAIMER
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
We disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Epic Gymnastics shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or Services.
Our total liability shall not exceed the amount paid by you in the six (6) months preceding the claim.
GOVERNING LAW
These Terms shall be governed by the laws of the State of Utah.
DISPUTE RESOLUTION – BINDING ARBITRATION
Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in the State of Utah under the rules of the American Arbitration Association.
You waive the right to trial by jury and agree disputes will not proceed as class actions.
ELECTRONIC COMMUNICATIONS
By submitting forms or registering through the Site, you consent to receive communications electronically and agree electronic agreements satisfy legal writing requirements.
MISCELLANEOUS
These Terms constitute the entire agreement between you and Epic Gymnastics regarding use of the Site and Services.
If any provision is deemed unenforceable, the remaining provisions remain in effect.
Failure to enforce any provision does not constitute waiver.
